Terms & Conditions
Effective Date: October 1, 2026 • Last Reviewed: October 2026
01 Commercial Scope & Agreement
Welcome to Amixon Digital ("Amixon", "we", "us", or "our"). By accessing our website (amixon.in), accepting a project proposal, or engaging our studio services, you ("Client", "you", or "your") agree to be bound by these Terms and Conditions.
Amixon Digital operates as a specialized digital growth studio providing:
- Website Design & Engineering: Responsive corporate websites, high-speed landing pages, WebGL/Three.js interactive experiences, and full CMS/e-commerce integrations built for sub-1.2s loading speeds.
- Digital Marketing & Paid Advertising: Direct-response Meta Ads (Facebook & Instagram), Google Search & Display funnels, Meta Conversion API (CAPI) infrastructure, and lead generation management.
- Graphic Design & Brand Systems: Complete corporate identity design, SVG vector logo suites, marketing creative packs, brand style guides, and print-ready collateral.
- WhatsApp Systems & Web Applications: Click-to-WhatsApp automated routing, custom booking portals, CRM webhooks, and modern web application interfaces.
Upon full financial settlement of your project invoice, 100% of all intellectual property, production source code, Figma design files, high-resolution vector assets, and advertising accounts belong exclusively to you. Amixon Digital does not enforce recurring vendor lock-in or proprietary hostage fees.
02 Project Sprints & Payment Milestones
To maintain transparent progress and clear accountability, our services operate on agreed sprint milestones defined in your formal project proposal:
- Initiation Advance: Work begins upon receipt of the agreed upfront deposit (typically 50% for standard web and brand projects; 100% upfront for single-month ad management retainers).
- Staging & Milestone Sign-off: Prior to public production deployment or full vector package handover, the client reviews the deliverable on our private staging server.
- Final Settlement: The remaining milestone balance (50%) is due upon staging approval, prior to production server deployment, domain DNS redirection, or repository transfer.
- Currency & Invoicing: All quotes are denominated in Indian Rupees (INR) or agreed US Dollars (USD) for international partners, inclusive of applicable taxes as itemized on your formal invoice.
03 Advertising Spend & Third-Party Networks
A cornerstone of Amixon Digital's operational integrity is complete financial transparency regarding paid media advertising:
- Direct-to-Network Billing: Ad spend (media budget) is paid directly by the client to advertising platforms (Meta Platforms, Inc., Google LLC) via your business credit card or payment profile linked inside your client-owned Ad Account.
- Agency Retainer Separation: Amixon Digital invoices strictly for strategic campaign architecture, creative production, audience modeling, copywriting, and daily bid optimization. We do not mark up or hide margins inside your media spend.
- No Guaranteed Outcomes: While our past case studies demonstrate consistent lead generation (e.g. 46 verified leads at ₹36.88 CPL) and 3.8x+ ROAS, digital advertising market conditions, auction competition, and consumer demand fluctuate. Amixon does not guarantee specific revenue figures or lead totals.
04 Revisions, Feedback & Scope Management
We strive for total client satisfaction while adhering to project timelines:
- Included Revision Rounds: Unless specified otherwise in your project agreement, each deliverable includes up to two (2) comprehensive rounds of feedback during the design and development sprint stages.
- Out-of-Scope Requests: Substantial feature additions, structural pivots after approved wireframes, or extra page requests outside the original project scope will be quoted transparently as an addendum before work proceeds.
- Client Review Responsiveness: Timely delivery depends on reciprocal cooperation. Delays exceeding 14 calendar days in providing required brand content, credentials, or milestone sign-offs may pause active sprints and reschedule release windows.
05 Intellectual Property & Portfolio Rights
Ownership parameters are structured cleanly:
- Pre-Existing Materials: The client retains all rights, trademarks, and copyright in pre-existing logos, images, copy, and brand assets provided to Amixon.
- Deliverables Ownership: Upon settlement of all invoices, Amixon assigns full worldwide rights in the final custom deliverables (compiled code, final graphics, vector brand assets) to the client.
- Open-Source Components: Websites and applications may utilize established open-source libraries (e.g., Three.js, Lenis, Tailwind) governed by MIT or Apache 2.0 licenses.
- Portfolio Presentation: Unless a formal Non-Disclosure Agreement (NDA) is executed prior to project kickoff, Amixon reserves the right to display the finished public website, branding case study, and anonymized performance metrics in our public portfolio and promotional channels.
06 Hosting, Maintenance & Third-Party Services
Amixon Digital prepares production-ready deployments compatible with high-performance cloud providers (Hostinger, Vercel, AWS, Cloudflare). We do not guarantee unbroken uptime or zero-downtime caused by third-party hosting server outages, domain registrar DNS failures, or platform API changes beyond our reasonable control.
Ongoing security updates, content updates, and server maintenance beyond the standard 30-day post-launch warranty window require an active monthly support agreement.
07 Limitation of Liability
To the maximum extent permitted by applicable law, Amixon Digital, its founder, contractors, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, revenue, or business reputation, arising from or related to our services, even if advised of the possibility of such damages.
Our total aggregate liability under any circumstances arising from or relating to a specific engagement shall not exceed the total fees actually received by Amixon Digital for the specific deliverable giving rise to the claim.
08 Governing Law & Dispute Resolution
These Terms and Conditions shall be governed by, construed, and enforced in accordance with the substantive laws of India. Any legal dispute, controversy, or claim arising out of or relating to these terms or our services shall be subject to the exclusive jurisdiction of the competent courts located in Bengaluru, Karnataka, India.
